We believe that people often proceed too quickly and without all the information available to them when trying to use or avoid using the Bankruptcy & Insolvency Act in the form of a Bankruptcy or a Consumer Proposal. As a result, it can often cost people more than just money and affect more than just you, if you have a partner or a spouse.
Trustees (LIT) only have two tools to offer you. Those are Bankruptcy and Proposals to your Creditors. And even though you feel you are hiring them to represent you, please be advised that they can never represent you in a legal proceeding. Should you require legal assistance for any reason, you will have to engage your own counsel. Also, keep in mind, that any information your provide to a Trustee can be shared with all of your creditors, including CRA. You are not entitled to client / solicitor privilege when dealing with a Trustee.
You may be surprised to learn that a Trustee (LIT) can never represent you in any legal environment. If you have to attend Court to obtain your discharge, you’ll either have to hire a Lawyer or represent yourself. That’s because the Trustee (LIT) is not your Legal Counsel. When you choose a Trustee (LIT), you’re simply engaging them to administer your file, not to represent you in any legal proceeding
